By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Takeoff Social provides software that businesses, including automotive dealerships ("Dealers"), use to create marketing content and communicate with their customers. When you interact with a chat assistant or other tool we operate for a Dealer, you are communicating with that Dealer through our platform.
Some responses and messages are produced by an automated virtual assistant and may use artificial intelligence. Automated responses can be incomplete or inaccurate and are provided for general information only. Vehicle availability, pricing, payments, fees, and offer terms are not final until confirmed in writing by the Dealer. Nothing generated by the assistant is an offer, a guarantee of financing or approval, or a binding quote.
If you provide your phone number and agree to be contacted, you authorize the relevant Dealer, and Takeoff Social acting on the Dealer's behalf, to send informational text messages and place calls, which may use automated means and AI-generated content. Message and data rates may apply, and message frequency varies. Consent is not a condition of any purchase. Reply STOP to unsubscribe or HELP for help. The Services, including their software, design, and content we provide, are owned by Takeoff Social LLC or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable permission to use the Services as intended. All rights not expressly granted are reserved.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AUTOMATED CONTENT WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAKEOFF SOCIAL LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
The Services help you communicate with independent Dealers. We are not responsible for a Dealer's products, offers, representations, or privacy practices, or for third-party websites the Services may link to.
We may update these Terms from time to time. Changes are effective when we post the updated Terms and revise the "Last updated" date. Your continued use of the Services means you accept the updated Terms.
